Prospec Building Inspections Perth

By engaging Prospec Building Inspections ("the Inspector", "we", "us", "our") for building inspection services, you ("the Client", "you", "your") agree to be bound by the following terms and conditions. Please read these terms carefully before booking an inspection.

Prospec Building Inspections is owned and operated by Mike Stone, a registered builder with over 20 years of experience in Perth. Mike personally conducts pre-purchase inspections. For construction stage inspections, inspections are performed by Mike or his highly experienced local building supervisor.

1. Scope of Inspection

Pre-Purchase Inspections

Pre-purchase building inspections are conducted in accordance with Australian Standard AS4349.1-2007. Termite inspections comply with AS4349.3 standards.

The inspection covers safe and accessible areas within 30 meters of the building, including:

  • Interior rooms and living spaces
  • Subfloor areas (where accessible)
  • Roof void/ceiling space (where accessible)
  • Roof exterior
  • Exterior walls, grounds, and structures

Construction Stage Inspections

Construction inspections are performed at key stages of the building process (slab, brickwork, roof frame, practical completion) to ensure work meets Australian Standards, the National Construction Code, and engineering requirements. These inspections help identify issues before they become costly problems after handover.

2. Limitations of Inspection

The inspection is a non-invasive visual assessment. Where applicable, moisture detection equipment may be used at the inspector's discretion to identify moisture issues such as rising damp, leaking showers, or active roof leaks.

The Inspector will NOT:

  • Cut, break, dismantle, or remove any objects, fixtures, or coverings
  • Inspect inside walls, between floors, or other concealed areas
  • Dig, excavate, or force entry to inaccessible areas
  • Provide certification of compliance with building codes or regulations
  • Conduct formal laboratory testing for asbestos, mold, or other hazardous materials (visual identification only in comprehensive packages)
  • Perform comprehensive electrical or plumbing testing (basic visual checks and functionality testing only)
  • Provide cost estimates for repairs or renovations
  • Inspect areas that are unsafe, inaccessible, or obstructed
  • Test pool pumps, spa equipment, reticulation systems, or advanced appliance functionality

3. Important Definitions

Major Defect

A defect of sufficient magnitude where rectification has to be carried out in order to avoid unsafe conditions, loss of utility, or further deterioration of the property.

Minor Defect

A defect other than a major defect, or a defect that is considered minor having regard to the age and condition of the property.

Safe and Reasonable Access

Areas where the inspector can safely inspect without risk to health or safety, and where access is not obstructed or requires removal of fixed structures.

4. Client Responsibilities & Agreements

By booking an inspection, the Client agrees to:

  • Payment: Pay for the inspection as per the agreed quote before the report is delivered
  • Cancellation: Provide at least 24 hours notice for cancellations. Cancellations made less than 24 hours before the scheduled inspection will incur a 50% cancellation fee
  • Access: Ensure the property is accessible and all areas agreed upon for inspection are available
  • Alternate Inspector: Accept the right of the Inspector to nominate an alternate qualified inspector if necessary
  • Report Limitations: Understand and accept the limitations of the inspection as outlined in these terms
  • Further Investigation: Obtain specialist reports for areas of concern (e.g., structural engineering, electrical, plumbing)

5. Liability Limitations

The Client acknowledges and agrees that:

  • The Inspector's maximum liability for any claim arising from the inspection is limited to the fee paid for the inspection
  • There is no guarantee that all defects will be discovered during the inspection
  • The Inspector is not responsible for work performed by other trades, contractors, or consultants
  • Hidden or concealed defects may exist that are not visible during a non-invasive inspection
  • The inspection reflects the condition of the property at the time of the inspection only
  • Weather conditions, property access, or other factors may limit the scope of inspection

6. Report Usage & Distribution

The inspection report is prepared exclusively for the Client named on the report. The Client agrees that:

  • The report cannot be sold, distributed, or provided to third parties without express written permission from the Inspector
  • The Client indemnifies the Inspector against any claims arising from unauthorized distribution of the report
  • The report is valid for the property condition at the time of inspection only and may become outdated
  • The report should not be relied upon by parties other than the named Client

7. Pricing & Payment Terms

  • All costs are as per the pre-agreed quote provided to the Client
  • Payment is due before the inspection report is released
  • Additional fees may apply for travel outside the Perth metropolitan area
  • Additional services (e.g., pool safety inspections, electrical safety checks) are quoted separately

8. Report Delivery Timeframes

Reports are often delivered within 24 hours of completing the inspection. Urgent same-day reports are available on request when you have tight settlement deadlines.

  • Pre-purchase inspections: Generally within 24 hours, urgent delivery available
  • Construction practical completion inspections: Same day report delivery (payment must be arranged first)
  • Complex or larger properties may require additional time
  • We will notify you if there are any delays

10. Acceptance of Terms

By submitting a booking request or accepting our quote, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
